1. Acceptance of these terms

By creating an account, subscribing, or otherwise using Option Ark (the "Service," operated by Option Ark, "we," "us," or "Option Ark"), you agree to these Terms of Service and our Disclaimer and Privacy Policy, which are incorporated by reference. If you don't agree, don't use the Service.

2. What the Service is

Option Ark is a subscription-based options screening tool. It scans a defined universe of stocks against configurable criteria — analyst ratings, balance-sheet health, earnings, and options-specific factors like delta, days-to-expiration, open interest, volume, and bid/ask spread — and presents the results as ranked setups, organized by strategy and risk tier. The Service does not place trades, manage funds, or provide personalized investment advice. See our Disclaimer for the full scope of what the Service is and isn't.

3. Eligibility

You must be at least 18 years old (or the age of legal majority in your jurisdiction, if higher) and legally able to enter into a binding contract to use the Service. By using Option Ark, you represent that you meet these requirements.

4. Your account

You're responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at [support email] if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscriptions and billing

Option Ark offers a free tier and a paid Premium tier. Premium subscriptions are billed on a recurring basis (monthly, unless otherwise stated at checkout) through our third-party payment processor. By subscribing, you authorize recurring charges to your payment method until you cancel.

• Use automated tools to access the Service in a way that degrades performance for other users;
• Share a paid account's login credentials with people outside your own use, or resell access to the Service;
• Use the Service for any unlawful purpose or in violation of any applicable securities law or regulation.

7. Intellectual property

The Option Ark name, logo, site design, and underlying software are owned by Option Ark. Market data displayed through the Service is licensed from third-party providers and remains their property; your use of it through Option Ark is subject to both these Terms and those providers' own usage restrictions.

8. Third-party data and links

Option Ark displays data from third-party market data and fundamentals providers. We don't control, and aren't responsible for, the accuracy, completeness, or timeliness of that data. Links to external sites (brokers, educational resources, etc.) are provided for convenience; we don't endorse and aren't responsible for third-party content.

9. Disclaimers of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DATA DISPLAYED WILL BE ACCURATE OR CURRENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Option Ark AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR TRADING LOSSES, ARISING FROM YOUR USE OF THE SERVICE OR ANY TRADING DECISION MADE IN CONNECTION WITH IT — WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE'VE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
